6 Month Rule

This rule is associated with being Summoned to court and shares a lot of similarities with the 14 day loophole.

A Summons to court is only issued under two circumstances with respect to Road Traffic Offences:

1) After you receive the Notice of Intended Prosecution you can opt to have your case heard in court to allow you to plea not guilty or to plea for a reduced sentence.

2) If the offence you have committed goes beyond the officer's permitted discretion you will be summoned to court.

The 6 month rule relates to the period of time in which the SUMMONS must be served so that in the normal course of events it will be received within 6 months of the date of the NIP/offence.

If the Summons is sent to an incorrect address then the Summons is still valid and deemed served. This is common when the car is a lease/hire car.
